A refund is due from electricity suppliers for a thumping tax (CSPE) which the ECJ has decided is illegal.
Download sample letter to claim your money back
The letter must be sent LRAR to your electricity provider asap, amount to put in the letter is the CSPE paid in the 2 years preceding the date of your letter. You will find the amounts on the rear of your bill.

Ah, but then according to this item from The Connexion, we are all about to be hit with an additional electricity bill:
"A NASTY surprise may soon drop into the letter box of households in France - an extra electricity bill from EDF, ahead of the 5% price increase set to come into force in August.
The public rapporteur of the country’s highest administrative court, the Conseil D’Etat, yesterday recommended that the government’s 2% limit on electricity price rises in 2012 should be overturned.
The 2% price rise was well below the 5.7% estimation made by the Regulatory Commission (CRE) at the time.
The recommendation said that the limit by former Prime Minister Jean-Marc Ayrault was not enough to cover EDF’s costs, and amounted to a distortion of the market.
The news will come as an early blow for new Prime Minister Manuel Vall’s administration. If the recommendation is upheld, retroactive bills of up to €40 may be sent to every household in France.
A final decision is expected in two weeks, and although the public rapporteur’s recommendation is not binding, his recommendations are generally followed.
The increase will apply to regulated electricity tariffs for homes and small businesses, which means it will affect about 27 million (90%) of households."

So the onus is on us to claim it, rather than the company, who illegally charged us the tax in the first place, to pay it automatically. Brilliant, but thanks for the info Noodles

I have ploughed through the links , one has an English translate button. My French is not good enough to break it down. I take it to be like the PPI claims in the respect that if it was illegal why is it not automatic?

Only got halfway through the judgement text in French to find out there was an English and Dutch version. Too tired now to concentrate on any text, will have another go tomorrow.

I've done my letter but I had to use Google to find out what LRAR means. I can possibly use recorded delivery from the UK but most tracked items are only tracked within the UK. I'll go to the post office on Tuesday & find out.

I'm interested to watch how this works out. I sent my letter over a week ago and it's been delivered. I'll bet that EDF will use all sorts of tactics to avoid/delay paying but maybe I'm just too cynical.

I have just been on frenchentree and it seems quite a few people have been in contact with their supplier, sent the aforementioned letter and have received phone calls from edf saying the tax is not illegal and no refunds will be given, anyone here received anything?

EDF refund
I've trawled through the French forums on this subject, and although the ruling was made in December, EDF seem to be saying that it's down to the government to make any refunds. I think it may be some time, if ever that they agree on how to do this. It doesn't appear that anyone has received their reimbursement yet.

From what I have read , it seems to be I know someone who knows someone who's friends mother's uncle has received a refund. There doesn't seem to be any first hand knowledge.

AS WE report in May’s Connexion, lawyers are advising that electricity users have the right to make a request for repayment of a tax that makes up part of electricity bills, back-dated for two years.
The Contribution au service public de l’électricité (CSPE) can make up to 10% of a typical bill and is meant to help companies cover costs such as investing in greener ways of generating electricity.
However the tax has been ruled to be a form of illegal state aid by the European Court of Justice, meaning that, in theory, users – whether individuals or firms – can apply to have tax paid over two years (24 months) refunded. The typical family using electric heating could, therefore, be due a refund of several hundred euros.
The outcome in France of such a request is not yet certain, and is expected to depend partly on a decision of the French Conseil d’Etat, which has yet to rule. However lawyers say that the letter of EU law means refunds are due and they urge applications are made as soon as possible before the Conseil potentially tries to impose more restrictive conditions on claims.
Applications should be made by lettre recommandée avec accusé de réception (LRAR) – recorded delivery with reception slip – including copies of your previous bills as proof of tax paid, for the last 24 months. It is advisable to keep a copy of your letter and the documents sent.
If you have not kept the paper bills you may be able to recuperate them online via your personal space on your supplier’s website. The bills should itemise the amounts of CSPE paid.
We suggest the following wording is used:

It may sound cynical, but obviously EDF is trying every means possible to avoid refunding money that was charged illegally in the first place. EDF should be forced to give back all of these charges at its own cost and not simply in response to people having to make a claim on it.

The article from Connexion posted by Inkflo states that letters claiming a refund should be sent to the President of the Energy Regulation Commission and not EDF. It also states that copies of relevant bills should be enclosed.

Thanks very much for the information and the example letter, Inkflow! Saves all of us who have not already claimed a lot of energy . We will find out whether we do indeed get the money back, but it is worth a try.
And of course it is true that if so ruled by the European Commission, the EDF or other supplier should be made to make the refund, but that would be a perfect world and suppliers will not act until they are made to do so.

I have received an email from EDF this morning. They say that they need more information, which they intend to get from somewhere. They will reply to my request within 30 days.
